This Mobile Application (“Mobile Application”) is made available to you by TIP Medical Communications, Inc. and its affiliates (collectively, the “Company,” “we, “our” or “us”). We respect your personal privacy and are committed to adhering to federal and state privacy laws and industry guidelines in order to protect you and your identity. This Mobile Application is designed to facilitate your organization’s event coordinating services, and, to that end, the information you provide through this Mobile Application will be accessible by the individual(s) within your organization responsible for such coordination through this Mobile Application (collectively, the “Event Coordinator”). This privacy policy (“Privacy Policy”) describes how we handle the personal information of users of the Mobile Application and related online services (collectively, the “Mobile Service”).

When you submit information via the Mobile Service, you consent to the collection, use and disclosure of that information in accordance with this Privacy Policy.

We reserve the right to occasionally update this Privacy Policy. At such time, we will also revise the “last updated” date at the end of the Privacy Policy. We recommend that you periodically review this Privacy Policy.

Personal Information We Collect and Use 

The Mobile Application Customer and End User Information and Publicly Identifiable Information: When using the Mobile Application you may be asked to provide information including your name, a user name selected by your organization or assigned by us, your email address, phone number, profile photo and other demographic information. When participating or planning events, you may also provide event descriptions or related statements that are accessible by persons accessing the Mobile Application in connection with those events. The Mobile Application may be subject to fees payable by the Event Coordinator and/or other users for services as described in the Mobile Application and/or the websites related thereto. If you elect to purchase a premium service, we may collect billing and payment information from you.

Additionally, the Mobile Application may also contain functionality which enables you to import profile information or contacts from third party services (e.g., LinkedIn, Facebook, Twitter, Gmail, FourSquare, Instagram, Vine, etc.) (collectively, “Third Party Social Media Accounts”). If you choose to do this, you may have to log into the applicable Third Party Social Media Account, using such account’s user name and password. The copy of the information received by us shall be subject to this Privacy Policy. However, any data maintained by such third party service and your use of that third party service will be subject to that third party’s terms of use and privacy policy and not covered by this Privacy Policy.

The Mobile Service may also include location functionality that relies upon collection of geo-location data from your mobile device and associate/store such location information with your submissions. Your mobile device may include settings to disable the Mobile Service’s access to your location. Please check your device and/or operating system instructions for availability and details. Note, however, that opting out of the Mobile Service’s collection of location information will cause its location-based features to be disabled.

Information Collected Through the Mobile Application: As you use the Mobile Application, certain information can be passively collected (that is, gathered without you actively providing the information) using various technologies. For example, when using the Mobile Application, we and/or our service providers may track mobile-specific information such as type of device you are using, the device ID, IP address, operating system, mobile internet browser, internet service provider, referring/exit pages, click patterns and the way in which the Mobile Application is used. In addition, when you view the Mobile Application, or the online components of the Mobile Service, we may store some information on your device. This information will be in the form of a cookie, flash cookie or similar file and will help us in many ways. We reserve the right to use, and to permit our service providers to use, such cookies, flash cookies and web beacons, as well as other comparable or future technologies, to collect information regarding usage of the Mobile Service. We passively collect information to understand what areas of the Mobile Service are most popular, which areas may require improvement and what technologies are being used by our visitors. This information helps us to update and improve the Mobile Service. We also use this information for security purposes, to detect and to block security breaches and to provide you with a safe online environment.

How We Use the Information We Collect

Event Coordinator: As described above, the Mobile Service is designed to facilitate event coordinating services with the assistance of a designated Event Coordinator from within your organization. The Event Coordinator will have access to some or all of the information you submit, including but not limited to your planned participation in an event. The Event Coordinator may also have discretion over whether to share such data with others. You should assume that your Event Coordinator will be able to see and use all of the information collected through the Mobile Service. The Company is not responsible for how your organization uses or discloses this information.

Our Use: We use the information collected to provide you services related to event coordination. Your information may be used by the Mobile Service to provide push notifications and messages to you. Except as otherwise stated, we may use information collected internally to operate the services described on the Mobile Service, to improve the Mobile Service, to customize the Mobile Service to your preferences, to communicate information to you (including information about our products and services), for research purposes and for any other purpose specified in this Privacy Policy or the End User Terms for this Mobile Application. We may also use your information to contact you about our own and third parties’ goods and services that may be of interest to you, and/or to display advertising in the Mobile Application to our advertisers’ target audiences. Your billing information (credit card number, billing address) will only be used to process transactions between you and Company. In addition, we may make full use of all information acquired through the Mobile Service that is not in personally identifiable form.

Sharing of Information: In addition to the disclosure of your information to the Event Coordinator as described above, we may disclose any of the information you provide:

(i) to contractors we use to support our business (such as hosting providers, technical support, web analytics and financial institutions), in which case we will require such third parties to agree to use it for the same purposes;

(ii) in the event of a sale, merger, liquidation, dissolution, reorganization, assignment or other transfer of the Company or the business of to which the information relates, in which case we will require any such buyer to agree to treat it in accordance with this Privacy Policy and use it for the same purposes;

(iii) to respond to law enforcement requests and subpoenas, where we believe in good faith that such response is required by applicable laws, court orders, or government regulations; and

(iv) in situations involving threats to the physical safety of any person.

We do not otherwise distribute to third parties your personally identifiable information. We, however, will have no liability for disclosure of information obtained due to errors in transmission or the unauthorized intervention of third parties.

Automated Information Collection: We may de-identify and aggregate your personal information (including, without limitation, usage statistics and geo-location information) with information from other users of the Mobile Service. We may use or disclose such aggregated information for purposes of operating, modifying, improving, promoting or otherwise commercializing the Mobile Service or the aggregate data, but in no event shall such aggregated information include any personally identifying information.

Opt Out and Choice
As noted above, your information is accessible to your organization’s Event Coordinator. If you do not want to share information with your Event Coordinator, you should discontinue use of the Mobile Service. From time-to-time, the Mobile Application may also incorporate privacy and/or sharing settings that will permit you to make elections as to whether and when certain data is shared. Please review the application settings and/or profile settings within the Mobile Application to see your available options, if any such as your profile photo.

You may also request to be removed from our database at any time via email at [email protected] and we will process your request as reasonably possible.

Postings/Discussions
If you post information to any message boards, discussions or other forums (“Forums”) through the Mobile Application or other components of the Mobile Service, that information is publicly available to anyone that has access to such Forums, and we cannot control how other parties will use that information. Please use care when posting to publicly available Forums. Your profile information is accessible through the Mobile Service in connection with your postings.

You may have the ability to post information from the Mobile Application to your Third Party Social Media Accounts. All such postings are also subject to the terms of use and privacy policy of the applicable third parties as well as the terms of this Privacy Policy.

Third-party Privacy Policies

Please be aware that the Mobile Application may contain, links to websites owned or controlled by a third party and may collect personally identifiable information about you. The information practices of those third-party websites are not covered by this Privacy Policy.

Security Measures

We work hard to protect your personal information. We use both technical and procedural methods to maintain the integrity and security of our databases, including the use of encryption and limited access to data. But you should keep in mind that no Internet transmission is ever completely secure or error-free. PLEASE NOTE: The safety and security of your information also depends on you. Never share your password with anyone else, notify us promptly if you believe your password security has been breached, and remember to secure and password protect your mobile device.

Our Policy Towards Children

This Mobile Service is not intended for children under the age of 13. We will not knowingly collect personally identifiable information from visitors under the age of 13. If a child has provided us with personally identifiable information, a parent or guardian of that child may contact us via e-mail at [email protected] if they would like this information deleted from our records. We will use reasonable efforts to delete the child’s information from our databases.

Adherence to EU-US and Swiss-US Privacy Shield Frameworks

TIP Medical Communications, Inc. complies with the EU-U.S. Privacy Shield and the Swiss-U.S. Privacy Shield Frameworks, as set forth by the U.S. Department of Commerce regarding the collection, use, and retention of personal information transferred from the European Union and/or Switzerland to the United States. TIP Medical Communications, Inc. has certified to the Department of Commerce that it adheres to the Privacy Shield Principles of notice, choice, accountability for onward transfer, security, data integrity and purpose limitation, access, and recourse, enforcement and liability.  If there is any conflict between the terms in this privacy policy and the Privacy Shield Principles, the Privacy Shield Principles shall govern.  To learn more about the Privacy Shield program, and to view TIP Medical Communications, Inc. certification, please visit https://www.privacyshield.gov/.

In compliance with the EU-US and Swiss-US Privacy Shield Principles, TIP Medical Communications, Inc. commits to resolve complaints about your privacy and our collection or use of your personal information.   • TIP Medical Communications, Inc. has engaged the ICDR/AAA as an independent dispute resolution provider to address unresolved Privacy Shield complaints. A company a privacy officer will respond to your inquiry within 45 days. Accessing, Correcting or Updating Personal Information

You have the right to access your personal information in order to correct, amend, update or delete information that is inaccurate or to request that we no longer use your personal information.
